No restrictions on free speech, that is a, HUGE, hole in the, constitution all right, the Grand Justice interpreted that the rights to free speech shall be, UNCONDITONAL here…that's still, the work of the DDP, off of the Front Page Sections, translated…
The constitutional court found that the insult on the occupational position to be, unconstitutional, and set up three evaluative means that will be difficult to match up to to determine of what constitutes as public humiliation. Seemingly, this protects the freedom of speech more, but the police officers working on the frontlines of things questioned, "the country won't even back up the law enforcement now", while the people are still, worried about being, checked if they criticized the government. The Grand Justice had drawn that red line now, but it'd, also made the freedom of speech looked like the curves of government officials', will.
The most directly affected by this decision was of how Yang took the net armies and defamed the Taiwanese consulate in Osaka, causing the former head of the consulate, Su to commit suicide. At the time, the post stated, "those in the Osaka office", are sleaze bags, those who are, against the party ruling the country, and surely, this was, public humiliation on those, specific, individuals.
what became of "free speech"...and, it don't matter if we now, libel or slander against each other, we can't and won't be, prosecuted...image from online
What's magical was, Yang may be found not guilty, due to this, new interpretation of public humiliation of the Constitutional Court; although she'd already been charged on obstruction of government business, the courts found her guilty on insulting the public occupation of the government officials, and now, the grand justice had, offered her a way to get off easy for publicly humiliating the government positions, and, her charges of public humiliation, taken away as well. Is this, the real aim of the grand justices' interpretation, to "free the guilty"?
Besides, just like from before, a grand justice believed, that "cussing someone out doesn't constitute as a crime", this greatly, limited the realms of public humiliation, which can add to the trend of people calling one another bad names in public, and this verdict, buried the seeds of causing even more conflicts verbally or physically for the future, other than the police, sighing how they weren't back up by the government for enforcing the law, the district attorneys also, worried, that the other law enforcement officers may be more timid as this law gets, signed into, effect.
The most basic of this problem lies in that the Grand Justice, seemingly had, guaranteed more freedom of speech to the people, but the chilling effect of the government's going after those who spoke against its rulings, along with the anti-infiltration laws are worsening; now, the country is, waiting to see, how the Grand Justices will, handle the imbalance of the curves of the freedom of, speech.
So, without any limits, the freedom speech can become, libel and slander, but, based off of this grand justice interpretation, there won't be any more, libel and slander charges being prosecuted, because our excuse is, hey, we're only, VOICING OUR, opinions, and our personal opinions are, protected by the free speech laws, and this is a HUGE hole in the systems.
There should be, limits to free speech, we can't just say things that we want to, because that would mean, that anybody can libel and slander, defame someone else, and the law's not going to do a thing, about it!
