The justifications of murdering his uncle, after a verbal altercation, as this man tried to get off easy, but the courts didn't give it to him, but, fifteen years is still, not enough, he'd MURDERED, HACKED his uncle to death, watched him bleed out! The man, Chien in Taoyuan, two years ago on November 24th in the evening, forgot to turn off the lights at, and his youngest uncle, Liu got into a verbal altercation with him on it, he'd modeled after the swords fighting movies, put on the cloth gloves, and, taped the cleavers onto his hands, hacked, stabbed his youngest uncle as many as twenty times, murdering him; the first trial, found him guilty on domestic violence murder, sentenced him to fifteen years eight months; the district attorney's office filed for an appeal, asking for life in prison, Chien also appealed, the second and third trials were tossed back, case closed.
The case was the very first of the jury trial in Taoyuan. Chien, at the time of the murder, he'd hacked and stabbed his youngest uncle's vital organs more than twenty times in front of his maternal grandfather and his mother, murdering his youngest uncle, during the trial of the Taoyuan District Court, the district attorney, Lee used the words of the literary person, Ji in the Ching Dynasty, asked for the life term.
The Collectivist Courts in the first trial found, that Chien was without stable work, and lived in a self-centered way, felt upset over his youngest uncle's long-term verbal abuse, used a very brutal means to murder, and after he'd stabbed and hacked his uncle to death, had his mother called up emergency, that he'd fitted to the criteria of turning himself in, but, he was of sound mind during the murder, no reduced sentencing applied, and he'd murdered his uncle in front of his own next-of-kin, until the final day of his trial, did he apologize to the older female cousin who came to court to hear the sentencing, he is sentenced to fifteen years eight months for murder.
The D.A. filed for an appeal, stated that Chien didn't even try to resuscitate his uncle after he'd stabbed and hacked him, that he'd not reached a settlement agreement with the families of the murdered victim, that it's hard to believe that he was remorseful, that he would only needed to serve half of the fifteen years eight months sentenced to him, and can make parole, that the extent of his crimes doesn't fit to the punishment, asked for the life term.
Chien also appealed, claimed that his uncle had called him trash, and threatened to chase him out of his home, that he was under enormous stress from losing his place of stay, that was what drove him to murder, that he was worried that he may be in the way of the paramedics' resuscitating his uncle, that was why he'd changed his clothes, and cleaned himself off, and asked for the psych evaluations during his second trial.
The second trial found, that Chien fitted to the criteria of turning himself in, that if he'd tried to save his uncle, the jury had considered, and the psych evaluations was not submitted due to Chien's not asking for it, and that his demands for reviewing the evaluations in his second trial did not fit to the criteria of the exception during the jury trial; Chien was sound in the cross examination processes, and argued for his own rights, that he'd shown no difference to intellect compared to the average person, maintained the verdict for the previous.
Chien used the same reasons, fought for another appeal, the Highest Courts found that there was NO reason for a third appeal from him, tossed back Chien's appeal, case settled.
And so, this man had, HACKED his uncle to death, and only received fifteen years and eight months for murder, and he was driven to murder because he finally SNAPPED toward his uncle's constantly nagging him, and he tried to find excuses for himself, to try and get a lighter sentence? Thankful the jury did NOT give it to him, otherwise, there would be NO justice for murder in this, case!
